Liability Waiver

This waiver explains the risk allocation that applies when Senders use ShareMyBag to connect with independent Travellers.

Effective Date: 24/04/26

This Liability Waiver ("Waiver") applies to all Senders using the ShareMyBag platform ("Platform"), operated by ShareMyBag ("we," "us," or "our"). By using ShareMyBag to send items, you agree to this Waiver.

1. Nature of Service

You acknowledge that:

  • ShareMyBag is a technology platform connecting Senders with independent Travellers
  • ShareMyBag does not provide delivery or courier services
  • All transportation is carried out by independent Travellers

2. Assumption of Risk

You understand and accept that:

  • Your parcel will be transported by a third-party Traveller
  • There are inherent risks, including loss, theft, damage, delay, and customs seizure

You agree to use the Platform at your own risk.

3. Limitation of Liability

To the maximum extent permitted by law, ShareMyBag shall not be liable for:

  • Loss, theft, or damage of items
  • Delays in delivery
  • Actions or omissions of Travellers

Maximum Liability Cap

Where liability cannot be excluded, ShareMyBag's total liability shall not exceed the service fee paid by the Sender.

4. No Guarantee

ShareMyBag does not guarantee:

  • Delivery timelines
  • Condition of items upon arrival
  • Successful completion of delivery

5. Packaging and Declaration

You agree that:

  • You are responsible for proper packaging of items
  • You will provide accurate and complete descriptions
  • You will not misrepresent the contents of any parcel

6. Prohibited Items

You agree not to send:

  • Illegal goods
  • Dangerous or hazardous materials
  • Restricted or undeclared items

If you violate this, you assume full legal responsibility and ShareMyBag may report the matter to authorities.

7. Insurance (Optional)

  • Insurance or protection services may be offered separately
  • Coverage is subject to specific terms and conditions
  • If you decline insurance, you bear full risk

8. Customs and Regulatory Risk

  • International shipments may be subject to customs checks
  • Items may be delayed, taxed, or confiscated

You accept full responsibility for compliance with all applicable laws.

9. No Agency Relationship

Nothing in this Waiver creates an employment relationship, partnership, or agency relationship between ShareMyBag and Travellers.

10. Indemnity

You agree to indemnify and hold ShareMyBag harmless from:

  • Claims arising from your shipment
  • Misrepresentation of parcel contents
  • Violation of any law or regulation

11. Disputes

  • Disputes should first be resolved between Sender and Traveller
  • ShareMyBag may assist but is not obligated to intervene
  • Any decision made by ShareMyBag is final

12. Modifications

We may update this Waiver at any time. Continued use of the Platform constitutes acceptance of updates.

13. Governing Law

This Waiver shall be governed by the laws of the Federal Republic of Nigeria.

14. Acceptance

By using ShareMyBag, you confirm that:

  • You have read and understood this Waiver
  • You accept all risks associated with using the Platform
